Pen to Portrait operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Pen to Portrait is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Personal Information We Collect or Process

Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. Customer Photographs and Personalised Artwork
Information we collect and why:
When you order a personalised portrait, we collect the reference photographs and other information you provide with your order. These photographs may contain images of you, relatives, other identifiable people, children or pets.
We use reference photographs and order information to:
- Create your personalised portrait
- Provide artwork proofs and requested revisions
- Print, package and fulfil your order
- Communicate with you about your order
- Respond to questions, replacement requests, complaints or disputes
- Maintain an accurate record of the commission
- Document the source and provenance of the finished artwork
- Protect our intellectual property and legal rights
We process this information where necessary to create and fulfil the personalised product you have ordered. We may also rely on our legitimate interests in maintaining appropriate commission records, supporting customers, evidencing authorship and protecting our intellectual property rights, provided that those interests are not overridden by the rights of an identifiable person shown in a photograph or artwork.
Services and storage:
Reference photographs and artwork may be processed or stored through:
- Shopify, which processes the order and associated customer information
- UploadKit, which provides the photograph-upload facility
- Google Workspace, which we use for business email, customer communication and secure file storage
- Secure devices and other storage services used by Pen to Portrait to create, administer and archive commissioned artwork
Access is restricted to Pen to Portrait and the service providers required to store, process or support these files.
Reference photographs and commission records:
Files stored by UploadKit are retained by UploadKit for up to 60 days. Pen to Portrait may securely download and retain its own copy of the reference photographs supplied with an order.
Reference photographs may be retained for as long as reasonably necessary to maintain an accurate record of the commission, document the source and provenance of the finished artwork, evidence the authority under which the portrait was created, protect our intellectual property rights, administer related customer requests and establish, exercise or defend legal claims.
Where a reference photograph is retained alongside the finished artwork, it forms part of Pen to Portrait’s private commission archive.
We periodically review the information held within our commission archive. Reference photographs will be securely deleted or anonymised when we no longer have a necessary and proportionate reason to retain them.
Finished artwork archive:
Pen to Portrait retains a private digital master copy of each finished illustration as part of its permanent artwork archive.
This archive allows us to maintain a complete record of the original artwork created by Pen to Portrait, evidence authorship, protect our intellectual property rights, maintain the provenance of commissioned artwork and support the continued operation and history of the business.
Finished master artwork is retained indefinitely for these purposes while Pen to Portrait continues to maintain its artwork archive or has another ongoing lawful reason to retain it.
Where finished artwork contains personal information, access will remain restricted and the archive will be periodically reviewed. We may retain artwork where we have compelling legitimate grounds, an intellectual-property requirement or another lawful reason to do so.
Website, social media and marketing use:
The private retention of reference photographs and finished artwork is separate from their use in marketing.
We will not display reference photographs, finished artwork or customer photographs on our website, social-media accounts, advertisements, portfolio or other marketing materials without asking for separate permission.
Providing marketing permission is optional and does not affect your order. Refusing or withdrawing marketing permission does not affect Pen to Portrait’s ownership of copyright or the private retention of its finished artwork and commission records.
Where permission has been provided, it may be withdrawn at any time by contacting hello@pentoportrait.com. We will stop future marketing use and remove the material from platforms and materials under our control where reasonably possible. Withdrawal does not affect use that took place before permission was withdrawn, and we may be unable to remove copies already shared or saved by other users.
Your rights and deletion requests:
You may contact hello@pentoportrait.com to ask about the photographs, artwork or personal information we hold or to request deletion.
The right to deletion is not absolute. Requests will be considered individually in accordance with applicable data-protection law. We may retain information or artwork where we have compelling legitimate grounds, a legal obligation, an intellectual-property requirement or where it is required for the establishment, exercise or defence of legal claims.
A request to stop marketing use does not automatically require the corresponding files to be removed from our private artwork and commission archive.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
- Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
- Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.

Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. Children's Data
Our website and ordering services are intended for adults. However, reference photographs provided by an adult customer may contain images of children. We process these photographs only for the purposes explained in the Customer Photographs and Personalised Artwork section of this Privacy Policy. Customers providing a photograph containing an identifiable child must be the child’s parent or legal guardian or have the necessary permission from their parent or legal guardian. We take particular care when storing and processing photographs containing children. These images will not be displayed publicly or used on our website, social-media accounts, advertisements, portfolio or other marketing materials without separate permission.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit.
